It is my great pleasure to provide comments about the quality of Ann Lipson’s work.  I came to this country on a J-1 visa without being subject to the two-year home residency requirement. Then, I transferred my J-1 visa to a different university program because the hosting professor promised me support for an H-1B visa and green card. On the first day I moved to the new program, I was given a new DS-2019 that subjected me to the two-year home residency requirement. I was very shocked about the visa officer’s decision, but she argued that the source of my salary came from the National Science Foundation (NSF) as a government agency and I would need to apply for a waiver if I wanted to switch to an H-1B visa. When we argued that I had not applied for an NSF grant and that the grant was not given to me because of the exchange program, the visa officer simply refused to correct her mistake.

I consulted with many prominent immigration firms across the country. Most were of the opinion that the University’s J-1 officer was right.  Fortunately, through her website, I discovered Ann as an attorney with extensive knowledge and experience about the complexities of the J-1 visa, especially the mistakes that university officials frequently make on the DS-2019 regarding “government funding” and the two-year home residency requirement.  Ann took the time to review my documents and designed a successful strategy.  Without any help from the international office at the university, she got a second advisory opinion that showed I am not subject to the two-year home residency requirement and therefore I  do not need a J-1 wavier.

I would strongly recommend Ann L. Lipson for anyone who has problems with their J-1 visa and who may (or may not!) need a waiver.
